Terms and Conditions - For Event Organizers

Selling Tickets on DesiConnectEvents.com

1. Scope

This Event Organizer Agreement ("Agreement") sets forth the terms and conditions for utilizing the ticketing services on DesiConnectEvents.com ("Platform"), owned by Nextgen Consulting Inc. (“Nextgen”). By accessing or using these services, the Organizer agrees to comply with the terms outlined in this Agreement, the Terms of Service, Organizer Terms, and Privacy Policy as provided on DesiConnectEvents.com.

2. Confidentiality

Both Nextgen and the Organizer agree to maintain the confidentiality of each other’s information, data, and credentials. Neither party nor their personnel shall disclose proprietary or confidential information to any third party without prior consent. Nextgen is committed to safeguarding the confidentiality of information developed by or disclosed to it by the Organizer, both during and after the term of this Agreement.

3. Eligibility

Organizers must possess the legal capacity to enter into this Agreement either on their own behalf or on behalf of the entity using the services. By agreeing to these terms, the Organizer confirms their organization does not engage in prohibited activities or transactions.

4. Ticket Listing and Event Information

  • Accurate Event Details: Organizers must provide complete and accurate event information, including name, date, time, venue, and ticket details.
  • Ticket Prices and Options: The Organizer is responsible for setting ticket prices and any related options or packages for the event.
  • Event Promotion: To boost event visibility, DesiConnectEvents.com may request promotional materials, such as images or videos.
  • Electronic Ticket Delivery: The Platform manages e-ticket delivery to customers via email. Organizers must ensure the accuracy of ticketing information and promptly address any issues with delivery.
  • Modifications and Ticket Limits: Organizers may update ticket details, including pricing and quantities, through their account. Changes may require approval before publication.

5. Fees and Pricing

  • Fees for Listing Tickets: Using the Platform's ticketing services requires the payment of applicable fees. Details of the fee structure are outlined in the seller agreement or provided by our sales team.
  • Compliance with Fee Agreements: Organizers agree to adhere to the agreed-upon fee structure for their event.

6. Taxes

  • Tax Responsibility: Organizers are solely responsible for calculating, collecting, and remitting all applicable taxes related to ticket sales, such as sales tax, value-added tax, or excise tax. Nextgen assumes no responsibility for tax obligations.
  • Providing Tax Information: Organizers may be required to provide tax-related information, such as a Tax Identification Number (TIN) or tax-exempt status. Inaccuracies that lead to additional liabilities for the Platform will result in reimbursement by the Organizer.
  • Consultation: The Platform does not offer tax or legal advice. Organizers should consult with qualified professionals to ensure compliance with applicable laws.

7. Payment Processing

  • Payment Methods: The Platform supports secure payment options, including credit cards, debit cards, and PayPal. Payments for ticket sales will be processed securely and disbursed to the Organizer as per the agreed payment schedule.
  • Cancelled Events: Organizers are responsible for managing refund requests and associated costs for cancelled events.
  • Refunds and Disputes: The Organizer bears sole responsibility for handling refunds and resolving disputes with ticket buyers. Nextgen disclaims any involvement in such matters.

8. Termination

Nextgen reserves the right to suspend or terminate the Organizer's access to the Platform for violations of this Agreement or any unauthorized or fraudulent activities.

9. Liability Waiver

Organizers release DesiConnectEvents.com and its parent company, Nextgen Consulting Inc., from any liability arising from tax obligations, inaccuracies in event details, or misuse of the Platform.

10. Governing Law and Jurisdiction

  • Applicable Laws: This Agreement is governed by the laws of the state of Georgia.
  • Amendments: Nextgen may modify these terms at its discretion. Any significant changes will be communicated to the Organizer, who remains responsible for reviewing the terms periodically.
